Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your access to and use of REDCRM ("we", "us"), an event-based activation platform for venues, restaurants and event organisers, available at getredcrm.com. By creating an account or using the service, you agree to these Terms.
2. Accounts
You are responsible for safeguarding your credentials and for all activity under your account. You must be at least 18 years old and have the authority to bind your organisation to these Terms.
3. Subscriptions & billing
Paid plans (1000, Pro, Basic) are billed monthly in advance and renew automatically until cancelled. Fees are exclusive of VAT where applicable. You may cancel at any time; your plan remains active until the end of the current billing period and fees already paid are non-refundable except where required by law.
4. Acceptable use
You agree not to use REDCRM to send unsolicited messages, upload data you do not have the right to process, infringe intellectual property, attempt to disrupt the service, or violate applicable law. You are responsible for obtaining lawful consent from your guests before uploading their personal data and for honouring opt-out requests.
5. Your content
You retain ownership of all data you upload. You grant us a limited licence to host, process and transmit it solely to operate the service. Our handling of personal data is described in the Privacy Policy.
6. Service availability
We aim for high availability but do not guarantee uninterrupted access. We may modify, suspend or discontinue features with reasonable notice. Scheduled maintenance and force majeure events are excluded from any availability commitments.
7. Disclaimers
The service is provided "as is" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement.
8. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or related to the service is limited to the fees you paid to REDCRM in the twelve months preceding the claim. We are not liable for indirect, incidental, special or consequential damages.
9. Termination
We may suspend or terminate your account if you breach these Terms. On termination, your right to use the service ends immediately and your data is deleted in accordance with the Privacy Policy.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 30 days before they take effect.
11. Governing law
These Terms are governed by the laws of the Netherlands. Disputes shall be submitted to the competent courts of Amsterdam, unless mandatory consumer law provides otherwise.
